These Terms of Service (the “Agreement”) are an agreement between ForumHosting.org (“Forum Hosting”, “us”, “our”, or the “Company”) and you (“User” or “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the products and services made available by Forum Hosting and of the ForumHosting.org website (collectively, the “Services”). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.

Forum Hosting reserves the right to change this Policy any time, so please, check this page at least once a month or when in doubt.

 

1. Spam

Forum Hosting is committed to a zero-tolerance, anti-spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either: Over the Forum Hosting network, by customers or any other users of the Forum Hosting network (including customers’ customers); AND/OR over ANY network— if the message sent advertises or mentions a site hosted on the Forum Hosting server. We also prohibit the selling products that can be used for spamming.

We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy.

You’ll NOT Upload, post or otherwise transmit any content any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “opt-in/opt-out,” “bulk email” or any other form of solicitation. THIS MEANS NO SPAM. WE WILL REMOVE YOUR ACCOUNT AND TERMINATE YOUR SERVICES IMMEDIATELY WITH NO REFUND IF YOU ARE FOUND TO BE IN VIOLATION OF THIS TERM OF SERVICE.

If you have any complaints or comments regarding Spam on our network, please direct them via the help desk to support.

2. Account Ownership

Forum Hosting is only responsible to the present owner of the Web hosting space. We verify ownership by credit card number (if paid for by credit card), name, address, email address, username, & password. If you give this information to any other party or give access to your email address on your account to another party, you risk having your Web site and any other information on your account changed and/or deleted. We are not responsible for any information on your account. you  should not reveal this information to another party who causes damage to your account and/or Web site.

If you are a Web designer and you are not the person paying for the hosting account we advise you to receive payment for your work before you publish it to our servers. Once the Web site is published to our servers the account owner has retained ownership of that content.

3. Content Policy

All services provided by Forum Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statutes without proper authorization. The subscriber agrees to indemnify and hold Forum Hosting harmless from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography and sex-related links or merchandising is prohibited on all Forum Hosting servers. This includes sites that may infer sexual content, or links to adult content elsewhere. Forum Hosting will be the sole arbiter in determining violations of this provision.

Those sites are also prohibited that promote any illegal activity or present content that may be damaging to Forum Hosting servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

* Pirated software Hacker programs or archives Warez sites Pornography or Adult Material

Forum Hosting will be the sole arbiter of what constitutes a violation of this provision. Forum Hosting does not host competitor sites or web pages promoting sites of its competitors.

Any deliberate attempt to cause damage to Forum Hosting or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.

 

4. Email Policy

Forum Hosting may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Your email account may not be referenced as originator, intermediary, or reply-to address of such email. We consider unsolicited mass email as any unsolicited email messages sent to more than 25 email addresses or more than 10 news groups.

All email boxes on your account should be kept below 10 MB each. This is normal for most accounts since email is typically accessed on a regular basis using an email client such as Outlook, Outlook Express, or Eudora.

Forum Hosting does not backup your e-mails. You are not supposed to store your e-mail on the server permanently. You are recommended to download e-mail through email clients such as Outlook, Outlook Express, or Eudora.

5. Backups

Full backups are made on daily basis for last 7 days only. No guarantees of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients’ responsibility to maintain local copies of their web content and any information on their account including but not limited to client’s website, email, databases, mailing lists, and archives. If loss of data occurs due to an error of Forum Hosting, we will attempt to recover the data at no charge to the client. If data loss occurs due to negligence of client in securing their account or by an action of the client, Forum Hosting will not be responsible.

6. Indemnification Policy

We reserve the right to refuse service to anyone for any reason not prohibited by law. We also reserve the right to terminate service to any customer for any reason not prohibited by law. You agree to use all Forum Hosting services and facilities at your own risk. Forum Hosting specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Forum Hosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Forum Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees, asserted against Forum Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Forum Hosting against liabilities arising out of; any injury to person or property caused by any products sold or otherwise distributed in connection with Forum Hosting’s server; any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; copyright infringement and any defective products sold to customer from Forum Hosting’s server.

7. Forum Hosting shall be the sole judge of what violates this Policy

Forum Hosting is only responsible to the present owner of the Web hosting space. We verify ownership by credit card number (if paid for by credit card), name, address, username, & password. If you give this information to any other party you risk having your Web site and any other information on your account changed and/or deleted. We are not responsible for any information on your account should you reveal this information.

8. Payment Policies And Fees

Full payment is required before any hosting service is rendered, which includes renewals. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. Prepayment is due each anniversary (one month, three months, six months, one year, two years) following the date the account was established. Additional features can be added at any time. Monthly feature prices are not prorated. Forum Hosting reserves the right to change prices or plans at any time.

9. Uptime Guarantee

If your shared or reseller server has a physical downtime that falls short of the 99.9% uptime guarantee, you may receive one (1) month of credit on your account. This uptime guarantee does not apply to planned maintenance. Approval of any credit is at the sole discretion of Forum Hosting and may be dependent upon the justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please create a support ticket to our Billing department with justification within thirty (30) days of the end of the month for which you are requesting a credit. Uptime guarantees only apply to shared and reseller solutions. Dedicated servers are covered by a network guarantee in which the credit is prorated for the amount of time the server is down which is not related to our uptime guarantee.

10. Package Upgrade

Upgrade to any higher plan is FREE. We transfer the current amount on a pro-rata basis. If you upgrade within one month then there is no deduction. After that we deduct the monthly charges from your balance. After 6 months there is no transfer of the current amount.

11. Package Downgrade

Please note that there is a $5 Downgrade fee for all shared hosting and reseller hosting plans.

12. Domain Name Expiration

A domain name will expire exactly after 1 year of registration. You can add multiple years to a domain registration at any time. Domain goes to Grace Period after it expires and remains in a grace period for 7-days. During this time, and we charge normal to renew the domain for one year. You are advised to renew domains before they expire as the expired domain can go into the Redemption Period any time without any notice. Once the domain is in the Redemption period, the renewal fee is in excess of $250.

13. Domain Name Transfer Out

Outward (Transfer Out) domains will be charged $5 unlock & transfer out administrative fee at the time of transfer.

14. Transfers

Our Transfers Team will make every effort to help you move your website to us. Transfers are provided as a courtesy service. We do not make any guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult, if not impossible, to migrate some or all account data. In some cases we may not be able to assist you in a transfer of data from an old host. The free transfer service is available for thirty (30) days from your sign up date. Transfers outside of the thirty (30) day period will incur a charge; please contact a member of our Transfers department to receive a price quote. In no event shall Forum Hosting be held liable for any lost or missing data or files resulting from a transfer to or from Forum Hosting. You are solely responsible for backing up your data in all circumstances

15. Billing and Payment Information

• Prepayment.
  It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree to pay for the Services in advance of the time period during which such Services are provided. Subject to applicable laws, rules, and regulations, payments received will be first applied to the oldest outstanding invoice in your billing account.
• Auto renewal.
  Unless otherwise provided, you agree that until and unless you notify Forum Hosting of your desire to cancel the Services, you will be billed on an automatically recurring basis to prevent any disruption to your Services, using your credit card or other billing information on file with us.
• Taxes.
  Listed fees for the Services do not include any applicable sales, use, revenue, excise or other taxes imposed by any taxing authority. Any applicable taxes will be added to Forum Hosting’s invoice as a separate charge to be paid by you. All fees are non-refundable when paid unless otherwise stated.
• Late Payment.
  All invoices must be paid within three (3) days of the invoice due date. Any invoice that is outstanding for more than three (3) days may result in the suspension or termination of Services. Access to the account will not be restored until payment has been received. If you fail to pay the fees as specified herein, Forum Hosting may suspend or terminate your account and pursue the collection costs incurred by Forum Hosting, including without limitation, any arbitration and legal fees, and reasonable attorneys’ fees. Forum Hosting will not activate new orders or activate new packages for customers who have an outstanding balance on their account.
• Domain Payments.
  It is solely your responsibility to notify Forum Hosting’s Billing department via a support ticket after purchasing a domain. Domain renewal notices are provided as a courtesy reminder and Forum Hosting is not responsible for a failure to renew a domain or a failure to notify a customer about a domain’s renewal. Domain renewals are billed and renewed thirty (30) days before the renew date.
• Fraud.
  It is a violation of this Agreement for you to misuse or fraudulently use credit cards, charge cards, electronic funds transfers, electronic checks, or any other payment method. Forum Hosting may report any such misuse or fraudulent use, as determined in Forum Hosting’s sole discretion, to governmental and law enforcement authorities, credit reporting services, financial institutions and/or credit card companies.
• Invoice Disputes.
  You have thirty (30) days to dispute any charge or payment processed by Forum Hosting. If you have any questions concerning a charge on your account, please reach out to our billing department for assistance.
• Payment Card Industry Security Standard Disclaimer.
  Forum Hosting complies with the Payment Card Industry Security Standard (“PCI Standard”) in connection with the collection and processing of our customer’s data and billing information. However, you are solely responsible for the security of the data and billing information on your User Website. Forum Hosting does not monitor User Websites for PCI compliance and we are not able to verify whether a User Website complies with the PCI Standard.

16. Money-Back Guarantee.

• Shared, VPS and Reseller Services.
  Forum Hosting offers a thirty (30) days money-back guarantee for Forum Hosting’s shared, VPS, and reseller hosting services only.
  Subject to the terms that if you are not completely satisfied with these hosting services and you terminate your account within thirty (30) days of signing up for the Services, you will be given a full refund of the amount paid for hosting.
  This money-back guarantee only applies to fees paid for hosting services and does not apply to domains, administrative fees, installation fees for custom softwares or any other setup fees, or to any fees for any other additional services.

17. Cancellations and Refunds.

• Payment Method.
  No refunds will be provided if you use any of the following methods of payment: bank wire transfers, Western Union payments, checks and money orders. If you use any of these payment methods, any applicable credit will be posted to your hosting account instead of a refund.
• Domain Renewals.
  Domain renewals are billed and renewed thirty (30) days before the renewal date. It is your responsibility to notify Forum Hosting’s
  Billing department via a support ticket to cancel any domain registration at least thirty (30) days prior to the renewal date. No refunds will be given once a domain is renewed. All domain registrations and renewals are final.

• Domain Name Fees.
• If your plan includes a free domain name and you cancel within 1 year, our standard fee of $17.99 for the domain name (and any applicable taxes) (the “Domain Name Fee”) will be deducted from your refund.

• Refund Eligibility.
  Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund. Violations of this Agreement will waive your rights under the refund policy.
• Non-refundable Products and Services.
  There are no refunds on dedicated servers, administrative fees, and installation fees for custom software and domains. Please note that domain refunds will only be considered if the domain was ordered in conjunction with a hosting package and will be issued at Forum Hosting’s sole discretion.
• Cancellation Process.
  You may terminate or cancel the Services by support ticket. In such event: (i) you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation and (ii) Forum Hosting may, in our sole discretion, refund all pre-paid fees for basic hosting services for the full months remaining after the effectiveness of such cancellation (i.e. no partial month fees shall be refunded) less any setup fees, applicable taxes and any discount applied for prepayment, provided that you are not in breach of this Agreement.Once we receive your cancellation form and have confirmed all necessary information with you via email, we will inform you in writing (typically email) that your account has been canceled. Your cancellation confirmation will contain a ticket/tracking number in the subject line for your reference and for verification purposes. You should immediately receive an automatic email with a tracking number stating that “Your request has been received….” Forum Hosting will confirm your request and process your cancellation shortly thereafter. If you do not hear back from us, or do not receive the automatic confirmation email within a few minutes after submitting your cancellation form, please contact us immediately via phone at: +92 (331) 3615344. We require all cancellations to be done through the online form in order to (a) confirm your identity, (b) confirm in writing that you are prepared for all of your files and emails to be removed, and (c) document the request. This process aims to reduce the likelihood of mistakes, fraudulent/malicious requests, and to ensure that you are aware that your files, emails, and account may be removed immediately and permanently after a cancellation request is processed.

  Cancellations for shared and reseller accounts will be effective on the account’s renewal date. Cancellations for dedicated and VPS accounts will be effective immediately.

• Foreign Currencies.
  Exchange rate fluctuations for international payments are constant and unavoidable. All refunds are processed in U.S. dollars and will reflect the exchange rate in effect on the date of the refund. All refunds are subject to this fluctuation and Forum Hosting is not responsible for any change in exchange rates between the time of payment and the time of refund.
• Termination
  Forum Hosting may terminate your access to the Services, in whole or in part, including deletion or confiscation of all files, content, and/or domain name registrations, without notice in the event that: (i) you fail to pay any fees due hereunder to Forum Hosting; (ii) you violate the terms and conditions of this Agreement; (iii) your conduct may harm Forum Hosting or others, cause Forum Hosting or others to incur liability, or disrupt Forum Hosting’s business operations (as determined by Forum Hosting in its sole discretion); (iv) you are abusive toward Forum Hosting’s staff in any manner; or (v) for any other lawful reason, including to comply with applicable law, or as otherwise specified in this Agreement. In such event, Forum Hosting will not refund to you any fees paid in advance of such termination, and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such termination.

18. Acknowledgement

Forum Hosting will abide by the laws of their customers’ country of residence irrespective of visa/nationality of the merchant.

UPON TERMINATION OF THE SERVICES FOR ANY REASON, USER CONTENT, USER WEBSITES, AND OTHER DATA WILL BE DELETED.
